GENERAL CONDITIONS AND TERMS HEIDEBOS RENTAL HOUSE OR TUSSEN HEIDE EN BOS
1. Rental period: The contract in question has been concluded for the aforementioned period. The tenant has no right to the property outside this period. In principle, a minimum stay of 2 nights applies.
2. The booking: The agreement is concluded between the landlord (= holiday home concessionaire) and the tenant. The landlord is not liable if the rental cannot proceed due to force majeure or unforeseen circumstances.
3. Pricing: The published prices are the prices per vacation home. The prices are as stated on the website. (subject to printing errors, unless a price reduction is explicitly stated in the contract). Additional services such as final cleaning and packages are payable separately (optional or mandatory). Please check your contract for details.
4. File fee: No file fees will be charged.
5. Deposit: When booking, you pay a deposit of 1/3 of the rental price within 7 days. The balance is payable 1 month before arrival. For bookings made less than 6 weeks before arrival, the full amount must be paid. In the event of late payment, Fuarte bv is entitled to unilaterally terminate the agreement.
6. Condition of the property: We personally inspect the vacation home on a regular basis. If anything deviates from the description or if there is any damage, you must report this immediately on site to the person in charge/owner, also to avoid this being attributed to you! The problem will then be resolved as quickly as possible. Complaints that are not reported during your stay will not be accepted afterwards. The following issues have already been reported and do not need to be reported again: Crack in the fruit drawer of the refrigerator, crack in the kitchen window.
Upon departure, you must leave the property in the same condition as you found it upon arrival. Any loss due to breakage or damage to the property or its contents must be compensated by the tenant. The rate stated for the final cleaning assumes that the property will be left in a proper condition. This means washing the dishes, wiping down the dining table/stove/countertop, placing trash in the appropriate bins, leaving no food scraps in the refrigerator or cabinets, cleaning the barbecue, leaving no food scraps in the jacuzzi, leaving no trash in the garden, etc. Failure to comply with these conditions may result in additional cleaning costs.
7. Deposit (Heidebos only): You are required to pay a deposit. The amount is EUR 275.00 per stay and must be transferred to the specified account no later than the day before arrival. The owner/person in charge on site has the right to deny you access to the property if this condition is not met. In the event of any damage, this amount may be deducted from the deposit. However, one broken glass or plate will not be charged as damage, nor will damage resulting from wear and tear. If the consultation about this damage does not lead to an agreement, the tenant will have to seek redress directly from the owner. If the vacation home is used properly, the deposit will in principle be refunded on the day of departure and no later than 4 days after departure.In exceptional cases, exceptions may be made to this obligation (regular guests, etc.).
8. Departure and arrival times: It is important that you strictly adhere to the arrival and departure times (for the exact times, see the property documentation).
9. Number of persons allowed: The number of persons occupying the property may not exceed the number stated in the contract. If, upon arrival, it appears that there are more people than stated in the contract, the owner has the right to charge an additional fee (€40/pp/night for rental prices < €1000/week and €80/pp/night for rental prices > €1000/week) or to refuse the excess persons. The Agency for Nature and Forests also does not allow tents to be set up on the property. Babies up to 2 years old are not counted. Please note that only 1 baby bed and high chair are available per vacation rental.
10.Energy costs (water, gas, and electricity): These are included in the rental price. Charging electric vehicles is not permitted in any of the properties. The electricity grid is not equipped for this. Energy consumption in the vacation home is measured and recorded. In case of misuse, the deposit will be retained in full. This also applies to campers: no electricity can be tapped from the property. There is a nice camper farm a few hundred meters away, which provides a suitable electricity network.
11. Accidents: The owner of the property is not responsible for any accidents in and around the property.
12. Cancellation conditions: In the event of cancellation by the tenant who has not taken out cancellation insurance or who is not covered by the insurance conditions, the tenant is liable for the advance payment (1/3 of the total amount) up to 8 weeks before arrival. From 8 weeks before arrival, the total rental price is due. In the event of early departure or non-use of the property, you are not entitled to any refund.
13. Insurance: As a tenant, you are required to have appropriate insurance. Any damage to your personal belongings caused by fire is not covered by the home's fire insurance. Please consult your insurer to check whether you have adequate coverage for this. You may need to take out additional holiday home cover for your family and home insurance. As a tenant, you are responsible for any damage not covered by your insurance. Fuarte bv cannot be held liable for any damage suffered by the tenant or third parties as a result of their stay in the holiday home.
14. Cancellation by Fuarte bv: If Fuarte bv is forced to cancel the stay due to force majeure (the property is no longer available due to, for example, death, divorce, fire, or other reasons), you will be notified immediately. The agreement will then be terminated without compensation and with a refund of all amounts paid by you.
15.Special conditions (Heidebos only): the properties were taken on concession by Fuarte bv from the Agency for Nature and Forests, which owns both properties and is part of the ‘Hoge Kempen National Park’ nature reserve. This means that the landlord and tenant must comply with and acknowledge the regulations in force in the nature reserve:
· Parking is only permitted in the designated parking spaces (2 available) or on the driveway (one behind the other).
· The ‘grass and forest’ area along the property can be used as a play area. The meadowland a little further away is a nature reserve and is intended as a breeding ground for birds, a wintering area for insects and butterflies, and a grazing area for wildlife. It is not permitted to enter this area (at the request of ANB).
16. Jacuzzi (only for Heidebos):
Please note that the jacuzzi may not be available during severe winter months (in which case a credit note will be issued- not for Airbnb customers - since the jacuzzi is included in the rental price). In addition, it is not permitted to consume food or drink in the jacuzzi. In such cases, the water in the jacuzzi can no longer be filtered and must be drained. (We have noticed that a glass of cava or wine can easily break in the jacuzzi). In that case, part of the deposit will be retained (calculated according to current energy prices for heating water + cleaning costs). Upon arrival, you will receive instructions on how to use it correctly. For longer stays (> 2 days), we ask you to check the water (also for your own safety) and, if necessary, add chlorine and PH+ and clean the water filter.
As landlords, we never know in advance what condition previous guests will leave the jacuzzi in. If the water needs to be completely drained, it may not be at the right temperature upon arrival. This is considered force majeure and does not constitute grounds for a refund. However, we always do everything we can to prevent this from happening. (In warm seasons, this is almost never the case, but in cold months it can be a problem due to the longer heating time - 12 to 16 hours).
17.. Other (Heidebos only):
-Due to past disturbances, we do not accept groups of young people or groups whose purpose is to party and disturb the quiet area around the property. As the landlord, we reserve the right to refuse access to the accommodation if the tenants do not comply with this.
- Dogs are allowed, provided this is indicated in advance. Dogs are not allowed in the bedrooms or on the sofas. Dogs are only allowed in the property if they stay in a crate. This gives the dog its own familiar place and prevents it from chewing on the furniture out of nervousness. We ask owners of dogs that are shedding to vacuum before departure and to ensure that dog feces is cleaned up before departure.
